CURING TITLE DEFECTS
The attorneys of Hein Schneider & Bond P.C. are routinely called upon to represent Insureds in claims against insured real property under Owner’s and Lender’s policies of title insurance, and work closely with claims counsel to cure title defects, resolve adverse claims to title and defend the Insureds in litigation filed against them. Our attorneys endeavor to attempt the resolution of title defects through preparation and cooperative execution of corrective documents, if possible, to cure title defects and establish an appropriate chain of title. However, we will aggressively and efficiently litigate cases to cure a title defect that cannot or should not be settled, including through actions to quiet title and for declaratory judgment, for reformation of instruments, lien priority suits, and suits to establish access.
Our seasoned team of title specialists and former in-house title counsel are adept at analyzing and identifying complex title issues and structuring an effective and efficient plan for resolution. Our experience allows us to quickly analyze and report to the Insurer on new claims, pending litigation, and to advise on the Insurer’s potential liability, and where necessary, to file actions for emergency injunctive relief.
