When appropriate, the real estate and litigation attorneys of Hein Schneider & Bond P.C. may file suit to judicially foreclose upon a lender’s interest in commercial or residential real property. Such action is usually filed in connection with lien priority litigation, actions against borrowers for reformation of instruments, equitable lien actions or actions to quiet title to property. We do not regularly handle statutory foreclosure.
We are not a foreclosure firm and our real estate litigators handle only those matters whose unique circumstances require additional handling and attention to detail that foreclosure firms generally do not provide. We are retained when court involvement is necessary to permit the lender to foreclose its mortgage or deed of trust, and to provide the lender with marketable title at the end of the foreclosure process.
