Grant Mabie secures judgment for his client, a commercial landlord, at trial.

Grant Mabie, representing a commercial property owner at trial, obtained a judgment in favor of the owner, and against a tenant, for damages and possession of the premises.  The case involved a tenant that failed to honor its obligations under a commercial lease.  The judgment awarded the owner 100% of the damages claimed among other relief.

Bill Sauerwein and Grant Mabie obtained Summary Judgment for an Insurer in policy coverage litigation.

Bill Sauerwein and Grant Mabie obtained Summary Judgment on behalf of a national title insurer that was sued in Greene County, Missouri.  The Plaintiff argued that the policy of title insurance afforded Plaintiff a defense and indemnity in ancillary litigation.  The court agreed that the national title insurer did not owe a duty to defend or a duty to indemnify the Plaintiff, because various policy exclusions applied, and the allegations made against the Plaintiff in the ancillary litigation fell outside of the coverage of the title insurance policy.

Settlement Agreement Enforced

On behalf of a lender client, Sauerwein Simon attorneys successfully argued and won a motion to enforce a settlement agreement in multi-party quiet title litigation. Favorable settlement at mediation was upheld despite borrower’s attempts to repudiate settlement.

Commercial Landlord/Tenant

On behalf of a commercial property owner, Grant Mabie successfully obtained a verdict in trial against commercial tenants and their business partners, who had denied liability under the lease as they were identified on the lease agreement. The court found the tenants and their partners had joint liability for debts of the partnership, which included amounts owed pursuant to the lease agreement. Verdict was later successfully amended and increased to include landlord’s attorney’s fees.

Grant Mabie Joins Firm

Grant Mabie has joined the firm after practicing with another St. Louis law area firm in the areas of civil litigation, real estate and bankruptcy matters. Grant is a 2008 St. Louis University School of Law graduate. His practice at Sauerwein Simon P.C. will focus on commercial law, real estate, insurance defense and title insurance litigation.
